What can be reported

There is no exhaustive list of unlawful acts or irregularities that may constitute the subject of a whistleblowing report. Reports are considered relevant when they concern conduct, risks, offences, or irregularities that are detrimental to the public interest. Whistleblowing does not concern personal complaints made by the reporting party.
The reported unlawful conduct must relate to situations of which the reporting party has become aware, either directly or indirectly, including incidentally, in connection with their employment relationship and the role held. Reports based solely on suspicion or hearsay cannot be considered worthy of protection, as it is necessary to safeguard the interests of the third parties concerned by the reported information and, at the same time, to prevent the administration or entity from carrying out internal investigations that may be ineffective and, in any case, costly.

Finally, the requirement of the truthfulness of the reported facts remains essential in order to protect the reported party.

Please note that the identity of the reporting person and any other information from which such identity may be directly or indirectly inferred may not be disclosed, without the explicit consent of the reporting person, to individuals other than those competent to receive or follow up on reports and expressly authorised to process such data pursuant to Articles 29 and 32(4) of Regulation (EU) 2016/679 and Article 2-quaterdecies of the Personal Data Protection Code set forth in Legislative Decree No. 196 of 30 June 2003.

Please note that, if the report is submitted anonymously, although the identity of the reporting person and any other information from which such identity may be directly or indirectly inferred may not be disclosed without the explicit consent of the reporting person to individuals other than those competent to receive or follow up on reports and expressly authorised to process such data pursuant to Articles 29 and 32(4) of Regulation (EU) 2016/679 and Article 2-quaterdecies of the Personal Data Protection Code set forth in Legislative Decree No. 196 of 30 June 2003, this anonymity will not allow the external officer in charge of the procedure to issue an acknowledgement of receipt of the report to the reporting person, to maintain communications with the reporting person, to request any additional information if necessary, or to provide feedback on the report.
